Dear Johnson:

On May 28, the US Court of International Trade ruled that the White House exceeded its authority by imposing reciprocal tariffs on other countries under the International Emergency Economic Powers Act (IEEPA). The court issued a permanent injunction against the enforcement of these tariffs and ordered US Customs and Border Protection to cease their collection after a period of 10 days. The ruling also strikes down the fentanyl tariffs imposed on China, Canada and Mexico in February, though it does not refer to tariffs implemented under Section 232 of the Trade Expansion Act. The Trump administration has already announced plans to appeal the decision. It is unclear how long the appeal process may last and whether Customs will follow the court order while the appeal is underway.
