基本法第23條規定特區政府應就七種有關國家安全之行為自行立法禁止之。這七種行為比較少人關注的是最後兩種：「禁止外國的政治性組織或團體在香港特區進行政治活動」及「禁止香港特區的政治性組織或團體與外國的政治性組織或團體建立聯繫」。這兩種行為中最關鍵的問題應該是何謂「政治性組織」。

值得留意的是，香港國安法有關勾結外國勢力罪的條文下，所指的外國勢力是指「外國或者境外機構、組織、人員」，顯然，香港國安法下所涉及的外國或境外勢力包括的範圍應比「政治性組織」更為廣闊。

我們亦留意到在《社團條例》下，社區事務主任如認為社團或其支部是政治性團體並與外國政治性組織或台灣地區政治性組織有聯繫，便可拒絕為該社團註冊。條例下「外國政治性組織」是指包括外國政府或其「政治分部」及其「代理人」或外國的「政黨或其代理人」。這定義比較清晰，唯一可能引致爭論的是何謂「外國政黨」。

在英國，最近通過的《國家安全法》下有一條名為「外國干預罪」；這條罪的有關條文把「外國勢力」定義為外國元首、政府及其轄下的授權機構或政黨。條文把「政黨」的定義界定為「管治政黨」，而後者是指任何有官職之成員的政黨。

一般而言，誰會對國家安全構成威脅是由政府而非法庭所決定的。新加坡、英國及美國有關國家安全的條例均有相近條文規定，只有政府才有權界定誰人或什麼組織或機構會對國家安全構成威脅。美國最高法院最近亦在一宗反恐案中確認誰屬恐怖組織應由政府作決定，而法庭亦會尊重政府的決定而接納該決定。基本法第13及14條分別規定香港特區的防務、外交事務乃屬特區高度自治範圍之外，由中央政府負責。毫無疑問，有關什麼人或組織會威脅國家安全的決定，亦理應由中央政府而非特區法庭負責；法庭的職能是負責在這前提下，判斷有沒有人犯法。

如此類推，如何界定什麼機構應被視為政治性組織可能亦屬中央權力，而非特區之責。儘管如此，假若這定義過於廣泛，可能直接影響到特區的國際金融及商業中心地位；因此在立法時，特區政府大可考慮以《社團條例》及英國國安法之定義為立法基礎。

話雖如此，特區的「政治性組織」與外國的「政治性組織」的定義可能並不相同。毋庸置疑，特區有一種不尋常的現象，便是有些「民間團體」實質上具頗大政治色彩，甚至不斷以「民間活動」推行政治性目的。在這方面，比較清晰的「聯繫」定義可能是關鍵所在。根據現行《社團條例》，「聯繫」是指接受外國政治性組織指使、操控或接受援助；在這定義下一般禮節上的接觸和交流可能並不涉及政治性聯繫而不須予以禁止。

行政長官已多次公開表示，希望最遲在2024年完成基本法第23條立法；若然，現在可能也是開始研究及討論何謂「政治性組織」的時候了。
